1. Introduction and Scope

National Works, Inc. (“National Works,” “the Company,” “we,” “us,” or “our”) respects your privacy and is committed to handling personal information responsibly. This Privacy Policy (the “Policy”) explains how we collect, use, disclose, retain, and protect information in connection with your visit to and use of nationalworks.com and any associated pages, forms, or online features that link to this Policy (collectively, the “Site”).

National Works, Inc. is a Texas-based specialty sewer services contractor providing sewer cleaning, closed-circuit television (CCTV) inspection, manhole and structure coating and rehabilitation, hydro-excavation, internal point repairs, sewer testing, and related underground utility services to municipalities, utility districts, engineering firms, general contractors, and commercial clients.

Our Site is primarily an informational and business-to-business resource. We do not sell products online, we do not require visitors to create accounts, and we do not knowingly collect personal information beyond what is reasonably necessary to respond to inquiries and conduct our business.

1.1 What This Policy Covers

This Policy applies to information we collect through the Site, through electronic communications you send to us in response to Site content (such as email or telephone inquiries prompted by the Site), and through our related online marketing activities.

1.2 What This Policy Does Not Cover

This Policy does not apply to:

Information collected offline in the ordinary course of performing contracted field services, except to the extent that information is also processed through the Site;
Information governed by a separately negotiated written agreement, master services agreement, purchase order, confidentiality agreement, or public-entity contract between National Works and a client, which will control in the event of any conflict with this Policy;
Information collected by third-party websites, platforms, or services that are not operated by National Works, including LinkedIn and other social media platforms, each of which maintains its own privacy practices; or
Employment records of National Works personnel, which are governed by internal human resources policies.

1.3 Acceptance

By accessing or using the Site, you acknowledge that you have read and understood this Policy. If you do not agree with our practices, please do not use the Site or submit information to us through it.

2. Information We Collect

We collect information in three principal ways: information you provide directly, information collected automatically through technology, and information we receive from third parties.

2.1 Information You Provide Directly

You are not required to provide personal information to browse most of the Site. However, we collect the following categories of information when you voluntarily submit it, such as through our online contact form, by email, or by telephone:

Contact and identification information — first name, last name, telephone number, email address, employer or organization name, and job title or role.
Inquiry and project information — the content of your message, together with any project details you choose to share, such as the location of a site, the type of infrastructure involved, project scope or specifications, timelines, bid or solicitation numbers, budget parameters, and service requirements.
Correspondence records — emails, form submissions, voicemail messages, call notes, meeting notes, and related records of our communications with you.
Vendor, subcontractor, and supplier information — business contact details, insurance and bonding information, licensing and certification information, and payment or remittance details submitted in connection with a business relationship.
Employment inquiry information — if you contact us regarding employment, information contained in your resume, application, or message, including work history, education, licenses and certifications, and references.

2.2 Information Collected Automatically

When you visit the Site, certain information is collected automatically by our web servers, hosting provider, content management system, and analytics tools:

Device and connection data — Internet Protocol (IP) address, browser type and version, operating system, device type, screen resolution, language preference, and internet service provider.
Usage data — pages and content viewed, date and time of access, time spent on pages, navigation paths within the Site, referring and exit pages, search terms entered on the Site, files downloaded, and links clicked.
Approximate location data — general geographic information (such as city, region, or metropolitan area) inferred from IP address. We do not collect precise geolocation data through the Site.
Log and security data — server logs, error reports, and security event records generated for site reliability, diagnostics, and protection against malicious activity.

2.3 Information From Third Parties

We may receive information about you from sources such as: our website hosting, form-processing, email, and analytics providers; publicly available sources, including government procurement portals, bid solicitation platforms, public records, and business directories; professional networking platforms; referrals from clients, engineering firms, general contractors, or industry partners; and trade associations and conference organizers where you have engaged with us.

2.4 Sensitive Information

We do not seek to collect “sensitive personal data” or “sensitive personal information” as those terms are defined under applicable state privacy laws — including Social Security numbers, driver’s license or government identification numbers, financial account credentials, precise geolocation, biometric or genetic data, health or medical information, racial or ethnic origin, religious beliefs, citizenship or immigration status, sexual orientation, or contents of private communications — through the public areas of the Site.

Please do not submit sensitive personal information through our online contact form or by unencrypted email. If a business relationship requires such information (for example, tax identification numbers for vendor onboarding or background-check information for site access), we will request it through an appropriate and secure channel.

3. Cookies and Similar Technologies

The Site uses cookies and similar technologies, which are small data files placed on your device that allow the Site to function properly, remember preferences, and measure performance. We and our service providers may use the following categories:

Strictly necessary cookies — required for the Site to operate securely and correctly, including session management, load balancing, form submission, and protection against spam and abusive automated traffic.

3.2 Managing Cookies

Most web browsers allow you to view, manage, delete, and block cookies through browser settings. Instructions are typically found in your browser’s “Help,” “Settings,” or “Privacy” menu. Please note that if you disable strictly necessary cookies, portions of the Site — including our contact form — may not function properly. Because cookie preferences are stored per browser and per device, you will need to set your preferences on each browser and device you use.

3.3 Do Not Track and Global Privacy Control

Some browsers transmit a “Do Not Track” (DNT) signal. Because no uniform industry or legal standard for interpreting DNT signals has been adopted, the Site does not currently respond to DNT signals. Where required by applicable state law, we honor recognized universal opt-out mechanisms, such as the Global Privacy Control (GPC), as a valid request to opt out of the sale of personal data and targeted advertising for the browser or device from which the signal is received.

4. How We Use Information

We use the information described above for legitimate business purposes, including to:

Respond to inquiries, requests for information, and service-related questions submitted through the Site;
Prepare, submit, and follow up on estimates, proposals, bids, qualifications packages, and responses to public solicitations;
Schedule, coordinate, perform, document, and invoice for sewer inspection, cleaning, coating, rehabilitation, testing, and related services;
Communicate with clients, prospective clients, engineers, general contractors, subcontractors, suppliers, and public agencies regarding projects and business matters;
Administer contracts, purchase orders, change orders, submittals, insurance and bonding requirements, safety documentation, and project close-out records;
Send informational, promotional, or educational communications about our services, capabilities, and industry developments, subject to your right to opt out at any time;
Operate, maintain, evaluate, troubleshoot, secure, and improve the Site and our online content;
Analyze usage trends and measure the effectiveness of our marketing and outreach;
Detect, investigate, prevent, and respond to fraud, spam, security incidents, misuse of the Site, and other unlawful or prohibited activity;
Evaluate employment inquiries, applications, and candidate qualifications;
Establish, exercise, or defend legal claims, and comply with applicable laws, regulations, subpoenas, court orders, audits, public-records obligations, and contractual requirements; and
Evaluate, negotiate, or complete a corporate transaction, including a merger, acquisition, financing, reorganization, or sale of assets.

We may also create and use aggregated, de-identified, or anonymized information that cannot reasonably be used to identify you. We maintain such information in de-identified form and do not attempt to re-identify it, except as permitted by law.

5. How We Disclose Information

We do not disclose personal information except as described in this Policy. We may disclose the categories of information described in Section 2 to the following categories of recipients:

Service providers and processors — vendors that perform services on our behalf, such as website hosting and maintenance, form processing, email delivery, cloud storage, information technology and security services, analytics, marketing support, accounting, payment processing, and document management. These parties are permitted to use the information only to provide services to us.
Project participants — clients, owners, public agencies, engineering and inspection firms, general contractors, subcontractors, equipment suppliers, and material manufacturers, where disclosure is necessary to bid, coordinate, perform, document, or warrant services.
Insurers, sureties, and financial institutions — in connection with insurance coverage, bonding, claims, credit, and financing.
Professional advisors — attorneys, auditors, accountants, and consultants, subject to obligations of confidentiality.
Governmental and regulatory authorities — where required for permitting, licensing, prevailing-wage or certified-payroll compliance, safety reporting, tax administration, or other legal obligations.
Legal and safety disclosures — where we believe in good faith that disclosure is necessary to comply with applicable law or legal process; to enforce our agreements or Terms and Conditions; to protect the rights, property, or safety of National Works, our personnel, our clients, or the public; or to investigate suspected fraud or security incidents.
Corporate transactions — to counterparties, advisors, and successors in connection with a merger, acquisition, reorganization, financing, bankruptcy, or sale of all or part of our business or assets, subject to appropriate confidentiality protections.
With your direction or consent — to any other party where you have asked or authorized us to share your information.

5.1 Public Records Notice

National Works regularly contracts with municipalities, utility districts, river authorities, and other governmental entities. Information you provide in connection with a public bid, solicitation, contract, or project — including correspondence and submitted documentation — may become subject to disclosure under the Texas Public Information Act or comparable federal, state, or local public-records laws. We have limited or no ability to prevent disclosure of records held by a governmental body, and disclosure by a governmental entity under such laws is outside our control.

6. Sale of Personal Data and Targeted Advertising

We do not sell personal data in exchange for monetary consideration, and we do not sell the personal data of consumers. We also do not knowingly sell or share the personal data of any individual we know to be under 18 years of age, and we do not use personal data for profiling in furtherance of decisions that produce legal or similarly significant effects concerning an individual.

Certain state privacy laws define “sale,” “share,” “cross-context behavioral advertising,” and “targeted advertising” broadly enough that the routine use of third-party analytics or advertising technologies on a website may be treated as falling within those definitions, even where no money changes hands. To the extent our use of such technologies is treated as a sale, a share, or processing for targeted advertising under applicable law, you may opt out at any time by following the instructions in Section 10 and Section 11, by adjusting your cookie settings, or by transmitting a recognized universal opt-out signal such as the Global Privacy Control.

We do not sell or process sensitive personal data for targeted advertising purposes.

7. Third-Party Websites and Social Media

The Site contains links to third-party websites and platforms, including our LinkedIn company page, telephone and email links, and, in some cases, the websites of clients, manufacturers, industry associations, or product lines referenced in our service descriptions. Logos and marks displayed on the Site to identify the public agencies and organizations we serve are the property of their respective owners.

We do not control and are not responsible for the privacy practices, content, security, or accuracy of any third-party website or platform. This Policy does not apply to those properties. We encourage you to review the privacy policy of any third-party site before providing information to it.

8. Data Retention

We retain personal information only for as long as reasonably necessary to fulfill the purposes described in this Policy, unless a longer retention period is required or permitted by law. In determining retention periods, we consider:

The nature, sensitivity, and volume of the information;
The status and duration of our relationship with you or your organization;
Contractual record-retention requirements, including those imposed by public-entity contracts and grant-funded projects;
Applicable statutes of limitation and the potential need to establish, exercise, or defend legal claims, including construction-defect, warranty, lien, and payment claims;
Tax, accounting, insurance, safety, environmental, and regulatory recordkeeping obligations; and
Our legitimate interest in maintaining accurate project histories, inspection records, and business records.

Inquiry and marketing records are generally retained for the period necessary to evaluate and respond to the inquiry and to maintain a record of business development activity. Project and contract records are typically retained for the longer of the period specified in the governing contract or the applicable limitations period. When information is no longer needed, we take reasonable steps to delete it, destroy it, or de-identify it.

9. Data Security

We maintain administrative, technical, and physical safeguards designed to protect personal information against unauthorized access, use, alteration, disclosure, loss, or destruction. These measures include access controls and role-based permissions, encryption of website traffic in transit, network and endpoint security controls, vendor due diligence, secure backup practices, and employee training on information handling and security awareness.

No method of transmission over the internet and no method of electronic storage is completely secure. While we work to protect information, we cannot guarantee absolute security, and you transmit information to us at your own risk. Email and web form submissions are not encrypted end-to-end and should not be used to transmit confidential, proprietary, or sensitive information. If you believe your interaction with us is no longer secure, or if you become aware of a security concern involving the Site, please contact us immediately using the information in Section 17.

10. Your Privacy Choices

Regardless of where you reside, you may exercise the following choices:

10.1 Marketing Emails

You may opt out of promotional email at any time by using the “unsubscribe” link in any marketing message or by contacting us directly. Please note that we may continue to send you transactional or relationship communications — such as responses to inquiries, project correspondence, scheduling notices, invoices, and contract-related notices — which are not promotional in nature and cannot be opted out of while an active business relationship exists.

10.2 Telephone and Text Messages

If you provide a telephone number, you may be contacted by National Works personnel by call or text regarding your inquiry, quote, or project. Message and data rates may apply. You may reply STOP to any text message to opt out of further text messages, or tell us directly that you prefer not to be contacted by phone.

10.3 Cookies and Tracking

You may manage cookies through your browser settings, use available analytics opt-outs, or transmit a Global Privacy Control signal, as described in Section 3.

10.4 Updating Your Information

You may ask us to correct or update the business contact information we hold about you at any time by contacting us using the information in Section 17.

11. State Privacy Rights and How to Exercise Them

A number of U.S. states — including Texas, California, Virginia, Colorado, Connecticut, Utah, Oregon, Montana, Delaware, Iowa, Nebraska, New Hampshire, New Jersey, Tennessee, Minnesota, Maryland, Indiana, Kentucky, and Rhode Island — have enacted comprehensive consumer privacy laws. If you are a resident of a state with such a law, and you interact with us as a consumer acting in an individual or household capacity, you may have some or all of the rights described below, subject to the exemptions and limitations of your state’s law.

11.1 Rights That May Be Available to You

Right to know or access — to confirm whether we process your personal data and to obtain access to that data.
Right to correct — to correct inaccuracies in the personal data we hold about you, taking into account the nature of the data and the purposes of processing.
Right to delete — to request deletion of personal data we have collected from or about you.
Right to data portability — to obtain a copy of personal data you provided to us in a portable and, to the extent technically feasible, readily usable format.
Right to opt out — to opt out of the processing of personal data for purposes of targeted advertising, the sale of personal data, or profiling in furtherance of decisions that produce legal or similarly significant effects.
Right to limit sensitive data processing — to withhold or withdraw consent for the processing of sensitive personal data.
Right to non-discrimination or non-retaliation — you will not be denied services, charged different prices, or provided a different level of quality solely because you exercised a privacy right.

11.2 Notice for Texas Residents

The Texas Data Privacy and Security Act (TDPSA) provides Texas residents with the rights described in Section 11.1. As disclosed in Section 6, we do not sell personal data, and we do not sell sensitive personal data or biometric data. If you are a Texas resident and wish to exercise your rights, follow the process in Section 11.4. If we deny your request, you may appeal as described in Section 11.5 and, if the appeal is denied, you may submit a complaint to the Office of the Attorney General of Texas at texasattorneygeneral.gov.

11.3 Business-to-Business and Employment Contexts

Most state privacy laws define a protected “consumer” to exclude individuals acting in a commercial or employment context. Because our Site is primarily a business-to-business resource, much of the information we collect — such as the business contact details of a city engineer, a public works director, a procurement officer, or a general contractor’s project manager — may fall outside the scope of those laws. We will nonetheless make reasonable efforts to honor requests we receive, consistent with our legal obligations and business records requirements.

11.4 How to Submit a Request

To exercise any of the rights above, contact us using any of the methods in Section 17 and clearly state the right you wish to exercise. To protect your information, we must be able to verify your identity before acting on a request. We may ask you to provide information that reasonably matches the information already in our records, such as the email address or telephone number you used to contact us, the approximate date of your inquiry, or the organization on whose behalf you contacted us. We will not require you to create an account solely to submit a request.

Authorized agents. You may designate an authorized agent to submit a request on your behalf. We may require the agent to provide proof of authorization and may require you to verify your identity directly with us.

Our response. We will respond to verifiable requests within the time period required by applicable law — generally 45 days — and may extend that period once by an additional 45 days where reasonably necessary, in which case we will notify you of the extension and the reason for it. We may decline a request in whole or in part where an exemption applies, where we cannot verify your identity, or where the request is manifestly unfounded, excessive, or repetitive; in that case we will explain the reason for the denial.

11.5 Appeals

If we decline to act on your request, you may appeal that decision within a reasonable period by contacting us using the information in Section 17 and writing “Privacy Request Appeal” in the subject line or opening sentence. We will review the appeal and inform you in writing of our decision, and the reasons supporting it, within 60 days of receipt (or such shorter period as your state’s law requires). If your appeal is denied, we will provide information about how you may contact your state’s attorney general to submit a complaint.

12. Additional Disclosures for California Residents

This section provides additional information required by the California Consumer Privacy Act, as amended by the California Privacy Rights Act (together, the “CCPA”), for California residents acting as consumers. The table below identifies the statutory categories of personal information we may have collected in the preceding twelve (12) months and the purposes for which we collect them.

We collect these categories from the sources described in Section 2 and disclose them to the categories of recipients described in Section 5, in each case for the business purposes described in Section 4. We have not sold personal information for monetary consideration and have not knowingly sold or shared the personal information of consumers under 16 years of age.

California “Shine the Light.” California Civil Code Section 1798.83 permits California residents to request information about disclosures of personal information to third parties for those parties’ direct marketing purposes. We do not make such disclosures. Requests may be directed to us using the information in Section 17.

13. Job Applicants

If you submit an employment inquiry or application, we use the information you provide to evaluate your candidacy, communicate with you about opportunities, verify credentials and references where permitted, and comply with applicable employment, safety, and equal-opportunity recordkeeping requirements. Where a position requires it, additional screening — such as motor vehicle records checks, drug and alcohol testing, or background checks required for access to secured facilities or public job sites — may be conducted separately and with appropriate notice and authorization. Applicant information is retained in accordance with applicable recordkeeping requirements and is not used for marketing purposes.

14. Children’s Privacy

The Site is intended for a business audience and is not directed to children. We do not knowingly collect personal information from children under the age of thirteen (13), and we do not knowingly sell or share the personal information of any individual under the age of eighteen (18). If you believe a child has provided personal information to us through the Site, please contact us using the information in Section 17 and we will take reasonable steps to delete that information promptly.

15. Users Located Outside the United States

The Site is operated in and directed to persons located in the United States, and our services are performed in Texas and surrounding markets. If you access the Site from outside the United States, you understand that your information will be transferred to, stored in, and processed in the United States, where data protection laws may differ from those of your jurisdiction. By using the Site or submitting information to us, you consent to that transfer and processing.

16. Changes to This Privacy Policy

We may update this Policy from time to time to reflect changes in our practices, technology, legal requirements, or business operations. When we do, we will revise the “Last Updated” date at the top of this page and post the revised Policy on the Site. If we make material changes, we will provide additional notice as required by applicable law, which may include a prominent notice on the Site. Your continued use of the Site after the revised Policy becomes effective constitutes your acknowledgment of the changes. We encourage you to review this Policy periodically.
